USER AGREEMENT
THE FOLLOWING SETS FORTH THE TERMS ON WHICH AT&T ILECS OFFER AND PROVIDE ACCESS TO AND USE OF THIS BULLETIN BOARD.
By using or accessing the [website], including by posting to the Bulletin Board or reviewing the postings on it, you agree to be bound by this User Agreement. We may amend this User Agreement at any time by modifying the User Agreement on our website. All amended terms shall be automatically effective the earlier of (i) ten (10) days after any such amended term is posted on our website, or (ii) your use or continued accessing of the Bulletin Board after any such amended term is posted.

- Bulletin Board is Only a Venue.
The Bulletin Board is provided as a convenience only. Its sole purpose is to provide a venue that allows CLECs that are considering discontinuing (vacating) a collocation arrangement within an AT&T ILEC premises, to post such arrangement in case another CLEC might be interested in taking an assignment of that arrangement. Except to the extent of the possible consenting to the assignment, none of the AT&T ILECs is a party to the assignment and any related transaction between CLECs.
Accordingly, AT&T ILECs are in no way responsible for the information posted on the Bulletin Board, or how any such information might be used, including without limitation, the collocation arrangements listed, the accuracy of the listings (in whole or in part), the ability or authority of a CLEC to assign any listed collocation arrangement, or the ability or authority of a CLEC to acquire such arrangements. AT&T ILECs do not undertake to investigate, and cannot provide any assurance, that any CLEC that posts such a collocation arrangement has accurately posted such information or is actually interested in completing or will complete an assignment.
2. Public Information.
By submitting information for posting to the Bulletin Board, you hereby waive any possible claim that such information is proprietary or confidential in any manner whatsoever. By submitting such information, it is considered and shall be deemed publicly available information, not subject to any disclosure protections.
3. Release.
You hereby release the AT&T ILECs (and their respective officers, directors, agents, subsidiaries and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with (i) your use or accessing the Bulletin Board, and (ii) any dispute you may have with any other user of this Bulletin Board including CLECs who post information on collocation arrangements. You hereby waive California Civil Code 1542, which says: 'A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.'
4. Responsibility for Information.
AT&T ILECs do not control, edit, or otherwise check the information provided by CLECs for posting to the Bulletin Board. The CLEC providing the information is solely responsible for the information (including its accuracy) that the CLEC submits for posting or otherwise making available through the Bulletin Board. The CLEC posting information accepts the responsibility by doing so to promptly and regularly review its information listed on the Bulletin Board, and correct any inaccurate information (including those inaccuracies arising from events subsequent to the submission of the information). CLEC information (or any items listed) must NOT: (a) be false, inaccurate or misleading; (b) be fraudulent; and (c) violate any law, statute, ordinance or regulation (including, but not limited to, those governing bankruptcy, unfair competition, anti-discrimination or false advertising). A CLEC interested in a listed collocation arrangement is solely responsible for contacting the listing CLEC to confirm the accuracy of the information posted on the Bulletin Board, and to otherwise discuss and conclude any possible assignment.
5. Warranty Disclaimer.
AT&T ILECS PROVIDE THE BULLETIN BOARD AND ACCESS THERETO 'AS AVAILABLE' AND ‘AS IS’ AND WITHOUT ANY WARRANTY, REPRESENTATION, OR CONDITION WHATSOEVER, EXPRESS, IMPLIED OR STATUTORY, WHICH ARE ALL DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW. AT&T ILECS SPECIFICALLY DISCLAIM ANY RESPONSIBILTY FOR THE ACCURACY OF ANY OF THE POSTED INFORMATION. THE AT&T ILECS SPECIFICALLY DISCLAIM ANY WARRANTY(IES) OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
6. Liability Limit.
IN NO EVENT SHALL AT&T ILECS BE LIABLE FOR DIRECT OR INDIRECT LOSSES OR DAMAGES ARISING FROM OR RELATED TO THE BULLETIN BOARD OR THIS AGREEMENT. This limitation applies to all losses and damages of any kind whatsoever (including general, special, consequential, incidental, punitive, exemplary, loss of income, loss of profits, or data), whether in contract, negligence or other tort theory, even if one or more AT&T ILECs have been advised of or should have know of the possibility of such losses or damages.
AT&T ILECS’ LIABILITY TO ANY CLEC OR ANY THIRD PARTY IN ANY CIRCUMSTANCE IS LIMITED TO THE LESSER [??] OF (i) THE ACTUAL DAMAGE INCURRED, AND (ii) $100.
The preceding 'Warranty Disclaimer' and Liability Limit' shall each survive the failure of any exclusive remedy.
7. Status of The User Agreement.
This User Agreement supplements, to the extent applicable, the provisions of your interconnection agreement with an AT&T ILEC(s) or applicable tariff, if any.
8. Discontinuance of Bulletin Board.
The AT&T ILECs reserve the right to discontinue the Bulletin Board at any time without notice.
I agree with the above conditions of use.

Required Information to Post Collocation Space on the Bulletin Board
Overview:
The Collocation Space Assignment Bulletin Board will give CLECs an opportunity to both post collocation spaces available for assignment to another CLEC and view collocation spaces posted by other CLECs. Space transactions may not occur on this website. However, the Bulletin Board will act as a venue to allow CLECs the ability to offer collocation spaces at AT&T ILECs’ premises.
Instructions for posting Collocation spaces:
1. Contact your company administrator for the CLEC site to get access or to have posted.
